Ethics in settlement negotiations:  what would you do?

The presentation will address several common settlement negotiation scenarios that implicate the Rules of Professional Conduct, including through the lens of empirical research on psychology and game framing.  An anonymous poll with allow audience members to indicate how they would proceed, and the poll results will provide information as to how other attorneys’ perspectives may differ.  Participants will gain a more thorough understanding of the interaction between ethical rules and attorney conduct during settlement negotiations.

Litigation is hard.  Life is harder.  Using the Code of Professionalism as a guide, Magistrate Judge Janis van Meerveld, lawyer and certified health and wellness coach Darleene Peters, and lawyer, City Council member, and mental health advocate Joe Giarrusso provide an inside look at the role of courts and counsel in declining civility and its impact on attorney mental health and wellness.
